Dispute Resolution

Whenever Powerbet refuses to pay alleged winnings to a customer or a customer refuses to pay an alleged debt to Powerbet, for any reason, and Powerbet and the customer are unable to resolve the dispute to the satisfaction of both parties:

Powerbet will inform the customer that the dispute will be referred to the Board for resolution, after which Powerbet will, within forty-eight hours, refer the dispute to the Board.

The customer is not precluded from lodging a complaint directly with the Board.

The Board shall conduct whatever investigation it deems necessary to resolve the dispute and shall serve a written notice on Powerbet and the customer, informing them of the Board’s resolution.

The resolution of the Board shall become effective on the date when the parties receive a written notice of the resolution.

General Terms

Powerbet is licensed by The Western Cape Gambling and Racing Board and undertakes to abide by all the applicable laws, regulations and rules. The contract between Powerbet and the customer is made in terms of these laws.

The customer warrants that they 18 years old or older and eligible to gamble. Powerbet accepts no responsibility for bets placed illegally and the customer warrants that they are legally entitled to place bets with Powerbet from the jurisdiction in which they reside. It may be illegal for residents of some countries to bet with Powerbet and access to the website does not imply it is legal to bet online from any country.

All winnings in respect of any bet must be claimed within ninety(90) days of the determination of the outcome of such bet. No disputes will be entered into after the expiration of this period.

Customers agree to abide by all legislated requirements,including but not limited to the various national and provincial gambling regulations, Powerbet’s rules, polices, terms and conditions, exchange control and FICA regulations.

The customer undertakes to notify Powerbet of any and all matters, including any change of personal information that might have a bearing on an approved registration.

If a customer is no longer able to read, understand, agree and comply with all Powerbet rules, policies and terms and conditions, without exception, they undertake to cease operating their Powerbet account immediately,and request Powerbet to close the account. Powerbet make no guarantees as to the availability of our website, markets or prices. Powerbet will not entertainany claims, and accepts no liability for losses sustained by a customer’s inability to access Powerbet markets or website, due to malfunction, cancellation of accounts, inability to provide markets, suspension of services or otherwise,regardless of the cause.

The customer is solely responsible for ensuring that he is familiar with the rules of any bets he or she places. The rules as published byThe Western Cape Gambling and Racing Board shall apply to all bets.

All content, text, examples, and rules on this website are the property of Powerbet Gaming (PTY) LTD and any unauthorized use or reproduction is prohibited.

The customer agrees to abide by the terms and conditions of any bonus offer or competition offered by Powerbet. Powerbet reserves the right to alter or amend the terms and conditions of any bonus offer or competition at any stage and at its absolute discretion, whether or not the customer has already taken any action as a result of a bonus offer orcompetition, including depositing money to their account or placing bets. The customer warrants that they will not take any action that could be construed as bonus offer or competition abuse, in particular to gain any financial advantage not specifically intended by Powerbet.

Powerbet reserves the right to communicate with customers unless the customer has explicitly requested not to be communicated with.

The customer warrant that they have read, understood, accepted and will comply with all Powerbet’s terms and conditions.

Money held by Powerbet in a customer account that is deemed to have been inactive for twelve months, no bets successfully placed, with be forfeited.

Limitation of Liability

None of the Parties involved in the provision of the Powerbet service, whether Powerbet, its staff, its agent, 3rd party contractors or otherwise shall be liable for any losses or damages (whether direct, incidental, consequential, indirect or punitive damages)) resulting from the use and/or abuse of the Powerbet services.

The customer indemnifies Powerbet against any harm caused due to inaccurate information obtained from our website or employees, including but not limited to sports schedules, locations, prices or results.

Powerbet and its software provider where applicable shall not be held liable for any loss or damages caused by a break down, malfunction or otherwise in software, hardware, internet communications or any occurrence. Powerbet reserves the right to cancel, at our discretion, any bet or transaction arising from such occurrence

Powerbet may, at its sole discretion and without incurring liability of any kind, and at any time suspend the Powerbet service in whole or in part. The Customer represents and warrants that it shall indemnify and hold harmless Powerbet and its licensees, successors, related entities, directors, officers, agents, members and employees and software provider (collectively, the “Powerbet Parties”) from and against any and all direct, general loss or damage, liabilities, losses, interest or penalties of whatsoever nature incurred or sustained by the Powerbet Parties and any costs and expenses (including, but not limited to reasonable attorneys’ fees) from claims or actions against any of the Licensor Parties based upon or from any information, content, materials or communications transmitted, received, displayed, used and/or contained on or through the Powerbet Website and any and all transactions processed thereby;

Any breach by the Customer of this Agreement

And/or any infringement or improper use by the Customer of the Powerbet Service

The Customer warrants and represents that neither the use, possession or availability of the Powerbet Services by the Customer will infringe upon or contravene any laws, regulations, ordinances and/or any other applicable codes and rules of conduct, in the jurisdiction in which they reside.

Notwithstanding anything to the contrary, under no circumstances shall Powerbet Parties be liable to one another hereunder for any indirect, incidental, special or consequential damages arising out of or in connection with this agreement, loss of business, profits, revenue, loss or damage arising from loss, damage and/or corruption of any data.

Sign Up and Registration Procedure

In order to utilize the services provided by Powerbet, a customer will need to open an account. Powerbet reserves the right to reject any registration for a new account, and or cancel an existing account at its sole discretion, and without communication to the customer or applicant.

Customers are only permitted one account and are specifically prohibited from opening multiple accounts in the name of or on behalf of other persons. We reserve the right to void any bets we deem to have been placed by a single customer on multiple accounts.

New accounts are enabled for banking and profile updates only. We will verify an account holders identity and age before enabling bet placement on an account. You are required to submit a certified copy of your ID or passport AND proof of address. Proof of address should be in one of the following forms:

-              A bill or account reflecting your home address, or

-              A lease or rental agreement; or

-              A bank profile statement.

All customers are required to supply their full names, South African ID number or passport number for non SA citizens, residential address and at least one contact telephone number.

Completion of the registration process implies that you have accepted and understood all of our terms and conditions. If you do not accept each and every term of this agreement, do not logon or open an account.

Customers warrant that all information set out in the application form is true and correct.

No person may open an account, activate an internet account or place a bet on this website unless you are 18 years of age or older. Minors may not under any circumstances use this website.

When you open an account on this website and every time you place a bet on this website you warrant that: -

You are 18 years of age or older; and

Your use of this website and the placing of bets on this website are restricted to jurisdictions where such is not prohibited by law.

Betting

Powerbet will cancel and void all bets and return all money deposited to an account that Powerbet or the authorities deem to have been registered by or on behalf of an individual under the age of 18.

Powerbet exclusively reserves the right,  to limit, reject and or cancel any bets accepted and confirmed by Powerbet that we deem to have been fraudulently or accidentally or erroneously placed (at our discretion).,

Powerbet exclusively reserves the right, to limit, reject and or cancel any bets accepted and confirmed by Powerbet where Powerbet has either negligently, erroneously or otherwise offered or set incorrect prices, teams or event start times including but not limited to incorrect prices, teams or event start times.

Once a bet has been placed and confirmed by a customer, the customer warrants the bet to be correct and can not request the bet to be cancelled.

Bets are only valid when accepted in accordance with all of Powerbet’s rules, polices and terms and conditions. 

Powerbet reserves the right to change or amend its rules, polices, terms and conditions at Powerbet’s own discretion and without notice to customers.

If Powerbet suspects that match fixing has occurred, Powerbet reserves the right to withhold all funds on affected accounts and supply all account information to the relevant authorities and/or refund the relevant bets.

The customer indemnifies Powerbet against any loss caused by incorrect credits or debits to his account, including but not limited to, incorrect deposits or winning bet payouts. The customer authorises Powerbet to debit any amounts which have been incorrectly credited (through error, negligence or otherwise) to the customer account.

Multiple bets containing related outcomes will be split between the related selections.

Powerbet reserves the right, and at our sole discretion, to choose the bet offering made available, including but not limited to: the events, markets, all betting options, odds, and the acceptance or refusal of any bets.  Powerbet may make available or terminate betting offerings on any sports, events, markets and betting options at their sole discretion and reserves the right to make any changes without notice to the customer.

Customers may not bet by any means not authorised by Powerbet, including but not limited to, robots and website or software manipulation. Powerbet reserves the right to cancel any bets deemed to have been placed by unauthorised means.

All bets and markets are subject to minimum and maximum stakes. The website will automatically adjust the stake on any bet that exceeds the maximum, prior to the customer submitting the bet. It is the customer’s responsibility to ensure that they are aware of any stake limit applied. All maximum stakes apply per customer, per bet and per day. The customer warrants that they will not attempt to deliberately exceed the stake limits and any bets placed in an attempt to avoid the application of these limits, including bets placed on accounts held by other customers and multiple bets placed on a single account in order to exceed the stake limit, will be voided at our discretion.

Bonuses

Bonuses are issued provided you have verified your account.

Bonuses need to be turned 3 times before withdrawals will be allowed.

Bonus itself is not withdraw-able. 

No exceptions will be made.

Banking - Deposits

You must register with Powerbet before making a deposit to your account.

Deposits to your betting account may be made by credit card or EFT. Payments must be from a credit card or bank account in your name.

We do not accept cash deposits as we are unable to verify the identity of the depositor.

Money deposited to your Powerbet account is held by Powerbet on your behalf until it is used to place a bet.

All winnings are returned to your Powerbet account.

Powerbet reserves the right to charge transaction fees, including but not limited to an amount equal to any credit card transaction fees.

Banking – Withdrawals

For EFT deposits we will require either a bank generated fax or email confirmation of your payment showing the account name before we will process a withdrawal.

For credit card payments we will require a faxed or emailed copy of your credit card before we will process a withdrawal.

Withdrawals from your betting account will only be made to a bank account in your name.

We can only pay out to South African bank accounts.

Customers are required to submit a certified copy of their South African ID or passport for non SA citizens and certified proof of residential address in order to comply with FICA requirements. No withdrawals can be processed until FICA requirements have been met.

Payments will be processed on any weekday, excluding public holidays, subject to 24hrs notice to effect payment.

Powerbet may withhold payment pending receipt in our bank account of all money paid to Powerbet by you.

Powerbet reserves the right to charge transaction fees, including but not limited to an amount equal to any credit card transaction fees, if we deem you to have deposited money and not used your account for legitimate betting purposes.

FICA (Financial Intelligence Centre Act) Requirements

Powerbet is an accountable institution and is required to report all transactions as legislated by FICA.

Customers are required to submit a certified copy of their South African ID(not older than 1 year)  or passport for non SA citizens and proof of residential address(not older than 3 months) in order to comply with FICA requirements.

Powerbet reserves the right to suspend any account that has not met FICA requirements.

Refund Policy

All money deposited to your Powerbet account is held by Powerbet on your behalf until it is utilized to place a bet.

Money held in your Powerbet account may be refunded on request, subject to 24 hours’ notice to enable Powerbet to verify that all of the Terms and Conditions have been complied with, including those under the heading Banking – Withdrawals.

Customer Data Privacy Policy

All information supplied is strictly confidential, and the customer agrees to the Powerbet privacy policy.

The customer consents to checks being made against appropriate 3rd party databases to verify identity, personal details or credit card information, and any other information supplied by the customer that Powerbet deems necessary to acquire independent verification. The parties with which Powerbet contracts for the verification of information may keep records of all data requests and data submitted to them by Powerbet.

All customer personal information is stored securely by Powerbet and will not be shared with 3rd parties, other than information required to process 3rd party checks and payments, which will be transmitted securely to Powerbet’s processors. Customers acknowledge that Powerbet will be required to supply their personal details and transaction records to The Western Cape Gambling and Racing Board and any other statutory body that legally requests access to the data. The customer acknowledges that although every endeavour has been made to ensure customer data privacy, Powerbet makes no guarantees, and will to the best of our ability ensure such information supplied by a customer is not made available to any third party except as required to by law.

The customer consents to the recording of all telephone conversations with Powerbet.

Powerbet tracks and stores information about customers’ use of the website, including the IP address of the computer used to place bets. If you require access to information on what data is held about you, this can be obtained by contacting us (in accordance with the Promotion of Access to Information Act No. 2 of 2000).

Security Policy

Powerbet secures all customer information, both online and offline.

All data is transmitted using SSL encryption.

The customer is solely responsible for the safekeeping of his login, password, security details and account details. The Customer indemnifies Powerbet against any claims, losses or damages arising from unauthorized use of his or her account. Unauthorised transactions on a customer account will only be cancelled at Powerbet’s discretion.

Delivery Policy

A confirmation message will be displayed on the website and an email sent to the customer’s email address when a bet has been placed successfully. Bets are deemed to have been accepted as soon as they have been registered on our systems and a transaction has been processed against the customer’s betting account, regardless of whether or not the confirmation message is received by the customer.

All bets accepted after the official start of an event will be void, unless the event is specifically labelled as being available for betting in running.

The customer is solely responsible for ensuring that bets are placed accurately. Bets cannot be cancelled by the customer once accepted by us.

Intellectual Property

The Customer or any other party shall have no right to copy, in whole or in part, the Powerbet Product, software and website and shall not modify, adapt, translate, reverse engineer, decompile, disassemble, re-distribute, re-sell or create derivative works based on the Powerbet Product, software and website.
